Updated 2026-10-24, 14 min read
These general terms govern access to the NameSapiens platform (namesapiens.com) and the purchase of the services offered by Super Sapiens AI, registered office at , VAT number , email ("NameSapiens" or the "Provider"). By using the platform or placing an order, the user (the "Customer") confirms that they have read and accepted these terms. The terms apply to both business and consumer Customers; clauses reserved to consumers are expressly identified.
1. Subject matter
NameSapiens is a platform offering AI-assisted naming services, domain name research and acquisition, support for domain recovery and trademark monitoring for brand protection. The services are described on the platform pages; the description published at the time of the order forms an integral part of the contract. Some tools (Name Check, quick domain check, UDRP Pre-Check) are offered free of charge and without warranty, within the limits set out in the Disclaimer.
2. Account
To purchase services you need an account, created through a sign-in link sent by email (magic link) or through Google sign-in. The Customer warrants that the email address provided is their own and undertakes not to allow unauthorised third parties to use their account. The Customer is responsible for all activity carried out through their account and undertakes to promptly report any unauthorised access to . The Provider may suspend or close accounts used in breach of these terms or of the law.
The services are reserved to adults. A Customer acting on behalf of a business confirms that they have the authority to bind it.
3. Orders and payment
3.1 Proforma. Every order generates a proforma stating the service, the price and the Provider's bank details. The proforma is not an invoice and does not constitute acceptance of the order.
3.2 Payment method. The only accepted payment method is bank transfer. We do not accept card payments, e-wallets or other instruments. The Customer must quote the proforma code shown on the document in the transfer reference; without it, matching the payment may be delayed.
3.3 Activation. The service is activated when the transfer is confirmed as credited to the Provider's account. The contract is concluded at that moment. The Provider confirms activation by email and subsequently issues the electronic invoice.
3.4 Expiry. The proforma is valid for 14 days from its date of issue. If payment has not been received by then, the order is automatically cancelled. A payment received after expiry is returned to the Customer or, at the Customer's request and subject to availability, applied to a new order.
3.5 Bank charges. Outgoing bank charges are borne by the Customer. The amount credited must match the proforma amount.
4. Prices
Prices shown on the platform are in euro and exclude VAT unless stated otherwise. VAT is applied on the proforma and invoice in accordance with the applicable rules based on the Customer's location. Prices may change at any time; the Customer is charged the price stated on the proforma accepted through payment. Fees and charges levied by third parties (registrars, registries, dispute resolution providers, escrow services) are not included unless expressly stated.
5. One-off services and subscriptions
5.1 One-off services. Naming services, domain acquisitions, recovery services and individual reports are delivered once against payment of the relevant proforma.
5.2 Subscriptions. The brand protection plans (Watch, Guard, Shield) are monthly subscriptions paid in advance. Renewal is not automatic in financial terms: before the end of each period the Provider issues a new proforma for the following period. Paying the new proforma by its due date ensures service continuity.
5.3 Non-payment. If payment is not received by the end of the paid period, the service continues for a 7-day grace period. If no payment is credited by the end of the grace period, the subscription enters a past_due state: monitoring and alerts continue, but takedown activities performed by the Provider are suspended. If no payment is credited within 30 days of the end of the paid period, the subscription is cancelled: monitoring stops and collected data remains available in read-only mode. Payment of a subsequent proforma reactivates the service from the date it is credited; suspended periods are not recovered.
5.4 Cancellation. The Customer may stop the subscription simply by not paying the new proforma, or by writing to . No refunds are given for periods already paid and started, subject to Section 12 for consumers.
6. Naming services
6.1 Delivery. The naming service produces, according to the plan purchased, a set of candidate names evaluated through the Name Readiness Score, a shortlist and a report. Delivery times stated on the platform are indicative and run from activation and from the Customer's completion of the brief.
6.2 Regeneration rounds. Each plan includes a defined number of regeneration rounds. A round consists of producing a new set of candidates from a brief updated by the Customer. Additional rounds may be purchased separately.
6.3 Expert review. Where included in the plan, human review consists of an examination of the shortlist by a naming expert of the Provider, with notes and recommendations, and where applicable a call. The review does not constitute legal advice.
6.4 No warranty of registrability. The Name Readiness Score and the trademark and domain pre-screening are preliminary assessment tools based on non-exhaustive public sources. The Provider does not warrant that a proposed name is registrable as a trademark, free from third-party rights, available as a domain at the time of registration, or free from unwanted meanings in languages and markets not analysed. Before any investment, the Customer is advised to commission a professional clearance search.
6.5 Ownership of names. Generated names are made available to the Customer, who is free to use, file and register them in their own name and at their own risk. The Provider claims no rights in the proposed names and does not guarantee their exclusivity against other platform users who may receive similar proposals.
7. Domain services
7.1 Anonymous acquisition. The acquisition service involves a fixed fee, due on order and non-refundable, covering the work of contacting and negotiating with the current domain holder, and a success fee, due only if the domain is actually transferred to the Customer, calculated as stated on the proforma. The Provider acts without disclosing the Customer's identity to the seller, unless this is necessary to complete the transfer or required by law.
7.2 Purchase price and escrow. The domain purchase price is agreed with the seller and approved by the Customer before any commitment. Payment of the purchase price is made through a third-party escrow service chosen by the Provider or agreed with the Customer. The Provider does not hold Customer funds intended for the seller and is not a party to the sale. Escrow fees are borne by the Customer unless otherwise agreed.
7.3 Backorder. The backorder service consists of attempting to register a domain at the moment it may be released. The Provider does not guarantee the outcome, which depends on the current holder, the registry and any competitors. If the domain is not obtained, the amount paid for the backorder is refunded in full, net of any third-party costs expressly identified as non-refundable on the proforma.
7.4 Defensive portfolio. The defensive portfolio service involves registering, in the Customer's name, the variants of the main domain approved by the Customer. Registration and renewal costs for individual domains are stated separately. The Customer owns the registered domains and is responsible for their renewal, unless a management service is expressly included.
7.5 Quick check. The quick domain availability check relies on real-time queries of public sources and may not reflect the actual status of a domain at every moment.
8. Domain recovery services
8.1 UDRP Pre-Check. The Pre-Check is a free, automated assessment which estimates, on the basis of the information provided by the Customer and public sources, the likelihood of a favourable outcome in a recovery procedure. It does not constitute legal advice, does not replace examination by a professional and does not bind the Provider or the partner law firm.
8.2 Procedures. Recovery procedures (UDRP, the .it Registry reassignment procedure, EURid ADR) are prepared and filed by the partner law firm working with the Provider, following an assessment of the case and the Customer's signature of the required engagement. The Provider handles case preparation and coordination; professional responsibility for the legal work rests with the partner firm within the scope of the engagement.
8.3 Costs. The Provider's fee for recovery services is stated on the proforma. Fees payable to the procedure provider (dispute resolution centre, registry) are borne by the Customer and charged separately, at cost, in the amount set by the provider according to the number of domains and panellists.
8.4 Assisted negotiation. The assisted negotiation service consists of contacting the domain holder with a view to obtaining a consensual transfer. The Provider does not guarantee the holder's willingness to negotiate or the outcome of the negotiation. Any sums payable to the holder are borne by the Customer and settled through escrow.
8.5 No guarantee of outcome. The outcome of a procedure depends on the decision of a third party. Neither the Provider nor the partner firm guarantees recovery of the domain, and the fee is due for the work performed regardless of the outcome.
9. Brand protection
9.1 Nature of the service. The Watch, Guard and Shield plans consist of periodic monitoring of public sources (trademark registers, domain RDAP data, certificate transparency logs, search engines, marketplaces, paste sites, depending on the plan) for signals that may conflict with the Customer's trademarks. The limits of each plan (number of trademarks, permutations, frequency, channels) are stated on the service page.
9.2 False positives and false negatives. Monitoring is automated and relies on third-party sources outside the Provider's control. The Customer acknowledges that the service may generate false positives (irrelevant findings) and false negatives (failure to detect existing threats), and that sources may be incomplete, delayed or temporarily unavailable. The service does not replace professional trademark watching or the advice of an attorney.
9.3 Takedown. The service generates communication templates (reports, removal requests, preliminary cease-and-desist letters) that the Customer may send themselves. Where the plan provides for it, the Provider may send communications in the Customer's name and on their behalf, subject to the Customer's approval of each individual sending. The Provider does not guarantee removal of the content or a response from the recipient. Formal legal action is handled through the partner law firm under a separate engagement.
9.4 Customer responsibility. The Customer warrants that they own or hold a licence to the trademarks entered and have the right to act in their defence. The Customer is responsible for communications sent to third parties on the basis of the generated templates and undertakes not to use them abusively.
10. Intellectual property
10.1 Platform. The platform, the software, the NameSapiens trademark, editorial content and the Name Readiness Score methodology are owned by the Provider or its licensors. Components released under open-source licences may be used under the terms of the relevant licence.
10.2 Reports. Reports, shortlists, scores and other deliverables produced for the Customer are licensed to the Customer on a non-exclusive, perpetual basis for internal use and for sharing with their own advisers and partners. The Customer may not resell the reports, offer them as a service to third parties or use them to train competing systems. The Provider retains ownership of the structure, templates and methodology. The Provider does not use the Customer's briefs and content for purposes other than delivering the service.
10.3 Customer content. The Customer retains all rights in the content they upload and grants the Provider a limited licence to process it in order to deliver the services. The Customer warrants that they have the right to upload such content.
11. Liability
11.1 The Provider undertakes to perform the services with professional diligence. Since the services rely on automated processing and on third-party public sources, the Provider does not warrant the accuracy, completeness or currency of information obtained from those sources, nor any specific result (registrability of a name, acquisition of a domain, outcome of a procedure, removal of content).
11.2 To the extent permitted by law, the Provider's liability for damages arising from performance of the contract is limited, towards business Customers, to the amount paid by the Customer for the service giving rise to the damage in the preceding 12 months. The Provider is not liable for indirect damages, loss of profit, loss of business opportunities or reputational damage, except in cases of wilful misconduct or gross negligence.
11.3 Nothing in these terms excludes or limits the Provider's liability for wilful misconduct or gross negligence, for personal injury, or in cases where the law does not allow limitation. Towards consumer Customers, the mandatory provisions of the Italian Consumer Code (Legislative Decree 206/2005) apply, and any clause of these terms found to conflict with them shall not apply.
11.4 The Provider is not liable for interruptions due to force majeure, unavailability of third-party sources or services, maintenance announced in advance, or conduct of the Customer in breach of these terms.
11.5 The Customer undertakes to indemnify the Provider against third-party claims arising from unlawful use of the services, names, domains or communication templates made available.
12. Consumer right of withdrawal
12.1 A Customer acting as a consumer under the Italian Consumer Code (Legislative Decree 206/2005) has the right to withdraw from the contract within 14 days of its conclusion, without giving reasons, by sending a notice to or to . The following form may be used: "I hereby give notice that I withdraw from my contract for the service [description], order no. [number], concluded on [date]. Name and address of the consumer: [...]. Date: [...]".
12.2 Under Article 59 of the Consumer Code, the right of withdrawal cannot be exercised for services whose performance has been fully completed before the end of the 14-day period, where performance began with the consumer's express agreement and acknowledgement that the right of withdrawal is lost once the contract has been fully performed. The consumer gives that agreement when ordering, by ticking the relevant box before the proforma is issued. This applies in particular to naming services with fast delivery and to individual reports.
12.3 If the consumer withdraws after requesting that performance begin but before the service is complete, they owe an amount proportionate to what has been performed up to the time of the withdrawal notice. In the event of withdrawal, the Provider refunds the sums due within 14 days of receiving the notice, by bank transfer to the account from which payment was received.
12.4 For subscriptions, withdrawal within 14 days of conclusion of the contract entitles the consumer to a refund of the period paid, less a proportionate amount for the days of service already provided.
13. Acceptable use
The Customer undertakes not to use the platform for unlawful purposes, to infringe third-party rights, to overload the systems, to circumvent the usage limits of the free tools, to scrape results or to develop competing services based on the platform's output. The Provider may suspend access in case of breach.
14. Term, suspension and termination
The Customer may close their account at any time. Closure does not entitle the Customer to a refund of services already paid for, subject to the consumer provisions. The Provider may terminate subscriptions with 30 days' notice, refunding the unused portion of the paid period. On termination, reports already delivered remain available to the Customer for download for 90 days.
15. Communications
Communications between the parties take place by email, to the address associated with the Customer's account and to for the Provider. Service communications (proformas, confirmations, alerts, deadlines) are an integral part of the service and are not marketing communications.
16. Governing law and jurisdiction
These terms are governed by Italian law. Any dispute concerning their interpretation or performance is subject to the exclusive jurisdiction of the courts of the place where the Provider has its registered office. If the Customer is a consumer, the competent court is that of the consumer's place of residence or domicile, where located in Italy, and the mandatory protections of the law of the consumer's country of residence within the European Union apply. Consumers may also use the European online dispute resolution platform made available by the European Commission.
17. Changes
The Provider may amend these terms to reflect legal, technical or service changes. Amendments are published on this page with the date of update and notified to Customers with an active subscription by email at least 30 days in advance. Amendments do not apply to orders already concluded. A Customer with an active subscription who does not wish to accept the new terms may choose not to renew at the end of the current period.
18. Final provisions
If any clause is held invalid, the remaining clauses remain in force. The Provider's failure to exercise a right does not constitute a waiver. These terms, together with the Privacy Policy, the Cookie Policy and the Disclaimer, constitute the entire agreement between the parties. In case of discrepancy between the Italian version and translations, the Italian version prevails.
