Registering a trademark is the beginning, not the end. From the next day onwards, someone can file a similar sign in another class, register your name with one letter changed, obtain a TLS certificate for a domain that imitates yours, open a social profile with your logo, or list products under your name on a marketplace. None of this gets reported to you. NameSapiens brand protection exists to find it before your customers do.

The problem, concretely

Threats to a trademark come from different directions and at different speeds:

  • Similar filings. A competitor, or someone acting in good faith, files a trademark that resembles yours. You have a limited window to oppose; miss it and you live with that mark for years.
  • Typosquatting and look-alike domains. Variants with swapped, missing or added letters, hyphens, different extensions. They are used for phishing, for intercepting traffic, or simply to sell you the domain back at a premium.
  • Suspicious TLS certificates. Anyone preparing a phishing site obtains a certificate first. Public certificate transparency logs make this visible to whoever is watching, often days before the site goes live.
  • Fake profiles. Social accounts with your name and your logo, answering your customers in your place.
  • Marketplaces. Listings that use your trademark to sell counterfeit or unauthorised goods.

How monitoring works

The system works exclusively on public sources, queried periodically according to your plan:

Source What we look for
Trademark registers (EUIPO, TMview, WIPO) New filings identical or similar to yours, by class and territory
Domain RDAP data Registrations of permutations of your name across dozens of extensions
Certificate transparency TLS certificates issued for domains that contain or imitate your trademark
Web and image search Sites, profiles and content using your name suspiciously
Marketplaces (Guard and Shield) Listings that mention the trademark
Paste sites and public dumps (Shield) Mentions of your domain or trademark in credential lists and leaked material

On activation we generate the permutations of your trademark (common typos, homoglyphs, added words such as "shop", "login", "support", hyphens, extensions) up to your plan's limit. You can review them and add your own.

Severity and deduplication

Every detected signal receives a severity (informational, low, medium, high, critical) calculated on explicit criteria: similarity to the trademark, presence of live content, phishing indicators, overlapping class of goods, domain age. Findings about the same object from different sources are deduplicated into a single case, so you do not get three alerts for the same domain just because it appeared in RDAP, in certificates and in a search. Each case has a status (new, under review, action in progress, resolved, dismissed) and you can mark it as a false positive: the system learns from your feedback for that trademark.

Takedown

When a case warrants action, Sapi generates the appropriate communication template: a report to the registrar or hosting provider, a removal request to a marketplace, a profile report to a social platform, a preliminary letter to a domain holder. The text is filled in with the case data and references to your trademark.

  • On Watch, you download the text and send it yourself.
  • On Guard and Shield, you can ask NameSapiens to send it in your name. Every sending requires your explicit approval; we track replies and update the case.

Takedown is not a substitute for legal action. If a case calls for a UDRP or formal proceedings, we hand it to the partner law firm under a separate engagement.

All plans are monthly subscriptions paid in advance by bank transfer against a proforma. Before each due date you receive the proforma for the following month; the service continues if payment arrives by the stated date. Prices are published on the plans page and exclude VAT.

Watch is for anyone with a trademark who wants to know if something happens without having to look every day. One digest a week, clear, with the new items at the top.

Guard is for companies with several trademarks or an e-commerce business: it adds phishing and marketplace monitoring, immediate alerts on high-severity cases and assisted takedown.

Shield is for portfolio owners: ten trademarks, five hundred permutations, paste monitoring to catch leaked credentials, two UDRP Pre-Checks included every month and a monthly report ready for management or your trademark adviser.

Honesty about the limits

Monitoring is automated and the sources belong to third parties. That means:

  • false positives are possible: a domain containing your name may belong to a legitimate business in another sector;
  • false negatives are possible: a source may be late, incomplete or temporarily unreachable, and a threat may slip through;
  • Italian trademarks are consulted through TMview, not directly in the UIBM database;
  • severity is a calculation, not a legal judgement.

The service does not replace professional trademark watching by an attorney, but it makes that watching much cheaper to complement, and gives those who never had it an early-warning system that did not exist before. Every alert shows the source and the raw data, so you can verify it yourself.

Getting started

Enter your trademark, choose a plan and receive the proforma. When the transfer is credited we generate the permutations, run the first full scan and show you the starting picture: often the most instructive part, because you discover what is already out there.

Frequently asked questions

Does the monitoring catch everything?
No, and no honest service can promise that. We work on public sources with different coverage and update cycles. We can miss a threat (false negative) or flag something harmless (false positive). Our aim is to reduce both over time, partly through your feedback on alerts.
Can I protect a trademark I have not registered yet?
Yes, you can monitor any name. Bear in mind, though, that takedown actions and recovery procedures are far more likely to succeed when the trademark is registered. If it is not yet, Sapi can help you work out the next steps.
What happens if I do not renew?
Before the paid month ends you receive a new proforma. If the transfer does not arrive, the subscription enters a past-due state and the service continues for a 7-day grace period; it is then suspended and the collected data remains available read-only. The next payment reactivates monitoring.
Who sends the takedown requests?
On Watch we generate the text and you send it. On Guard and Shield we can send it in your name, after you have approved each individual communication. Formal legal action, such as a UDRP, goes through our partner law firm under a separate engagement.
Can I change plans?
Yes. Upgrading is immediate, with a proforma for the balance of the current period; downgrading takes effect at the next renewal.
